Service and Payment Conditions
Please read the following service and payment conditions carefully before using this website.
By using the Clinical Graphics image analysis service you acknowledge that you accept and will be bound by these service and payment conditions. If you do not agree to these service and payment conditions, do not use the image analysis service. Our service and payment conditions can be changed at any time without prior notice. Updated versions of the service and payment conditions will appear on this website and are effective immediately. You are responsible for regularly reviewing the service and payment conditions. Continued use of the image analysis service after any such changes constitutes your acceptance of such changes.
Clinical Graphics is owned and operated by Zimmer Biomet Holdings, Inc. (Clinical Graphics and Zimmer Biomet Holdings being collectively referred to in this notice as “Clinical Graphics”).
1. Service
The provided service is an image analysis service. The Clinical Graphics team, part of Zimmer Biomet, uses software to process the scans as provided by the client. The type of analysis is indicated by the client when a request is posted on the website (named a “job”). The results of analysis are communicated with a PDF file that is uploaded to the Clinical Graphics online portal typically within 10 working days after the scan data has been received.
2. Supply of scan data
By uploading or entering x-rays, MRI images, other files or any other content (“Patient Content”) to the website, you represent and agree that: you and the patient grants us with the irrevocable, world-wide, fully paid up and royalty free license to any and all rights that you may have to use Patient Content to develop our products for an individual patient on your behalf and for our other legitimate business, research, and development purposes.
If you upload or post patient information (for example, health or treatment information including x-rays or medical images that relate to an individual) to one of our websites (for example, if you are a healthcare professional, hospital, medical scanning facility or similar health care provider or one of their representatives that is a Clinical Graphics customer or acting on behalf of a Clinical Graphics customer), please note that you are responsible for obtaining any consent required under applicable laws from the relevant individual before uploading or posting the information. In addition, you are responsible for complying with all applicable privacy laws.
No identifying patient information (e.g., name, address, email address, or telephone number) should be disclosed to the Clinical Graphics team including in image submissions unless specifically requested by us.
3. Supply of scan data
Scans can be delivered by means of the online uploader at www.clinicalgraphics.com. Clients must indicate for which joint side an analysis is expected. The analysis of both left and right joints is handled and billed as two scan requests. Clients are responsible for supplying the Clinical Graphics Team with suitable scan data and accompanying data that may be required to analyze a scan. If a client provides data that is not suitable for analysis, the Clinical Graphics Team will notify this client within 2 working days.
4. Uptime of the service
The Clinical Graphics team, part of Zimmer Biomet, will use commercially reasonable efforts to make the service available, as measured over the course of a one-month period, an average of 99% of the time (and thereby the availability of analysis reports).
5. Support
The Clinical Graphics team, part of Zimmer Biomet, schedules support between 9 AM and 5.30 PM on working days, in the GMT+1 time zone, with the exception of public holidays.
6. Billing
The amount owed for analysis of scan data and other terms and conditions are covered in a service agreement executed by the local Zimmer Biomet entity. Delivered PDF reports are not replaced by updated versions, unless it concerns a new delivery as specified in Article 7.
8. Complaints and customer feedback
Complaints must be communicated to the Clinical Graphics team, part of Zimmer Biomet, within 15 working days after delivery of a PDF report. Whenever possible, erroneous PDF reports will be replaced by corrected PDF reports. If this is not possible, a full refund may be provided.
9. Security
The Clinical Graphics team, part of Zimmer Biomet, has put in place safeguards to protect your Personal Information from loss, misuse, alteration, theft, unauthorized access, or unauthorized disclosure. However, as is the case with all websites, we unfortunately are not able to guarantee security for data collected through our websites.
Scan data is stored on our servers for 30 days. PDF reports will be available on our website for at least 12 months.
10. Website Terms
By using this website and image analysis service, Clients also accept to be bound by the Terms of Service. If you do not agree to these Terms of Service, do not continue to use this site.
11. Privacy Policy
By using this website and image analysis service, Clients also accept to be bound by the Zimmer Biomet Privacy Policy. If you do not agree to this Privacy Policy, do not continue to use this site.
